Legal question? Not sure if this is the right board...

My primary reason for entering Audiotool is so that I can create music for a visual novel that I intend to publish and distribute for monetary gain. I looked into the Terms of Use and found the following:

"1.4 The arrangements and files created with the audiotool are wholly owned by the artists and users that generated the arrangement. The user and artist is kept liable under any circumstance for maintaining all rights on material he used from other sources than provided by the audiotool."

I just wanted to make sure of what's allowed before beginning to invest in the site, so that I don't end up hitting a wall and need to find another site later on.

Does this mean that I, as the owner of the tracks I create by arranging the provided loops, samples, and tools in Audiotool, can legally use the tracks I create in my visual novel(which I intend to sell) without penalty or paying royalties?

  • if you ask for the loop owners permission if it's by other users you should be fine.

    • I will record a sample of off somewhere, upload it on AT, then somebody asks me permission to use it, sure go ahead, I don't mind, and? The guy using it can run into troubles. I will not give a fifth of a half-eaten shit about that.

      Bottom line is, you don't upload sounds that don't belong to you here on AT.

      And you do use sounds by other users on your own risk because nobody knows where it comes from, and permission from the user will not help you in any way if you run into legal problems.

    As far as you use samples provided by audiotool / newloops / AT Resource collective, you are ok to use the music for your Novel.

    If you do use samples provided by other users then you should be concerned, because they may not be clean.

  • You can, but....you can't sell these tracks because the loops and samples AREN'T yours unless they say non-copyrighted or free use
