Sampling from Public Domain

Hey wasup. So I recently learned about something called the public domain. Basically, its something that stipulates that any song that was made in 1922 or earlier is 100% free for public use (this means remixing, re-creating, or just using it in other media). I assume that this date is constantly being pushed up and I think it has different terms and applications in other countries (I live in USA). Anyways, I am curious what your thoughts on this are. Are they ok to sample, or should I leave it alone? - Ethan8rswg

  • The only example of a time you would be able to use Public domain works, is if you were to use original Public Domain material, and perform or record it yourself. For example, reading the words from a book published before the 1900's your okay. Creating your own composition and recording of "Happy Birthday", also okay. Any kind of audio, video, recording or performance of public domain works not created by you is not public or okay for you to modify or redistribute on the audiotool sample browser without permission. Do not sample tracks that aren't made by you. You will have to create and re-sample your own recordings.

  • I'd be careful anyway because even if a musical work falls under public domain, it usually only refers to the composition, not the sound recording. For example, Beethoven's compositions are in the public domain, but sound recordings of those compositions aren't, because they were produced more recently or because they follow different copyright rules.
